2) Scope and definitions
2.1. These Terms apply to understandings, downloads, services, and access that you purchase through our WooCommerce checkout.
2.2. “Digital Products” include downloadable files (e.g., PDF workbooks) and access to online course materials (e.g., video libraries) delivered digitally.
2.3. “Services” include live sessions such as mentoring calls, group Q&A calls, or other live support explicitly described as a service on the product page.
3) Contract conclusion
3.1. Product descriptions on the website do not constitute a legally binding offer.
3.2. A binding contract is concluded when you place an order through checkout and we accept it by sending an order confirmation and/or granting access to the product (depending on the product type and payment method).
3.3. You are responsible for ensuring your email address is correct and capable of receiving transactional emails.
4) Delivery and access
4.1. Digital Products (PDF downloads): After successful payment, you will receive access to the download link via the checkout page and/or email, depending on your store configuration.
4.2. Community and course access: Some products include an invite link or access mechanism to our Circle community and course content. Access may be granted immediately or shortly after purchase.
4.3. Third-party platforms: Community and video hosting may be provided via third-party platforms (e.g., Circle). Availability and performance of these platforms are outside our direct control. We will make reasonable efforts to maintain access, but we do not guarantee uninterrupted access at all times.
5) Licence and permitted use (important)
5.1. When you purchase a Digital Product, you receive a personal, non-exclusive, non-transferable, revocable licence to use it for your own purposes.
5.2. You may not (a) share, resell, redistribute, upload, publicly post, or otherwise make the materials available to third parties; (b) remove copyright notices; (c) create derivative products for resale based on the materials.
5.3. If you want to use materials for teams, organisations, or group licences, contact us at legal@yukicarlsson.com for written permission.
6) Community access and conduct
6.1. If your purchase includes community access, you agree to follow community guidelines and interact respectfully.
6.2. We may remove content, restrict access, or suspend/terminate accounts that violate guidelines, laws, or the rights and safety of others.
6.3. If access is terminated due to a serious breach, you are not entitled to a refund unless required by law.
7) Mentoring and live services
7.1. Mentoring, Q&A calls, and similar offerings are educational and informational. They are not medical, psychological, legal, or financial services.
7.2. You remain responsible for your decisions and actions. We do not guarantee specific outcomes.
7.3. Where a service includes scheduled calls, details (timing, format, access links) are provided on the product page or within the programme space after purchase.
8) Scheduling, recordings, and missed sessions (services)
8.1. Unless otherwise stated, live calls may be scheduled at fixed times and may be subject to change with reasonable notice.
8.2. If a recording is offered, access to the recording may be time-limited or conditional as stated in the product description.
8.3. If you miss a live session, no replacement session is owed unless explicitly stated on the product page.
9) Prices, taxes, and payment
9.1. Prices are shown in EUR/USD as displayed at checkout.
9.2. If applicable, VAT/sales tax is handled according to the rules that apply to your purchase and location and as configured in the shop.
9.3. Payment is processed through our payment providers. Your order may be refused if payment fails or is reversed.
10) Statutory consumer right of withdrawal (EU/EEA/UK consumers)
10.1. If you are a consumer residing in the EU/EEA/UK, you may have a statutory right of withdrawal. Details are set out in our Right of Withdrawal.
10.2. Digital content and immediate access: If you expressly request immediate access/performance and acknowledge the loss of the withdrawal right, your right of withdrawal can expire once performance begins (i.e., once download/access is provided), as described in the Cancellation Policy and confirmed via checkout checkbox.
10.3. Services: If you request that services begin during the withdrawal period, withdrawal rules may differ from digital content. Where applicable, you may be required to pay for services provided up to the time of withdrawal, as described in the Cancellation Policy.
11) Refund policy (non-statutory)
11.1. Except where required by law, purchases of Digital Products are generally non-refundable once access/download has been provided.
11.2. For services and programmes, any goodwill refunds or special conditions will be stated on the product page. If none are stated, no contractual right to a refund is granted beyond statutory rights.
12) Defects and availability
12.1. If you receive a defective file (e.g., corrupted download), contact us and we will provide a functional replacement within a reasonable time.
12.2. If a Digital Product is materially unavailable for reasons attributable to us and cannot be remedied within a reasonable time, statutory remedies remain unaffected.
13) Intellectual property
All materials (PDFs, videos, text, frameworks, brand elements, graphics) are protected by copyright and other rights. All rights not expressly granted to you remain reserved.
14) Liability
14.1. We are liable without limitation for intent and gross negligence and for damages resulting from injury to life, body, or health.
14.2. In cases of slight negligence, we are liable only for breach of essential contractual obligations (cardinal duties) and only for foreseeable, typical damages.
14.3. Liability is otherwise excluded to the extent permitted by law.
14.4. Nothing in these Terms limits mandatory consumer rights.
15) Changes to products and terms
15.1. We may update Digital Products, community content, or platform structure to improve delivery, provided the essential features of your purchased product are not materially reduced.
15.2. We may update these Terms for legitimate reasons (legal changes, security, operational reasons). The version in effect at the time of purchase applies to that purchase.
16) Governing law and jurisdiction
16.1. These Terms are governed by the laws of the Federal Republic of Germany.
16.2. If you are a consumer, mandatory consumer protection laws of your country of residence remain unaffected.
16.3. If you are a merchant, the place of jurisdiction is Aschaffenburg, Germany, to the extent permissible.
17) Severability
If any provision of these Terms is invalid, the remaining provisions remain effective.
